ROSS, C.J. This is an appeal from a judgment in an action brought by C. A. Stewart against the Salt River Valley Water Users Association, a corporation, to recover damages for alleged injuries to the plaintiffs land and crops caused by flooding his premises through an irrigation ditch constructed and maintained by the defendant. The cause was tried to the court without a jury, and resulted in a verdict and judgment in favor of the plaintiff. Defendant has appealed.
